Terms and Conditions

These Terms and Conditions (“Terms”) govern the provision of life coaching services by Triple Nine Coaching (“Coach”, “we”, “us”, “our”) to you (“Client”, “you”, “your”). By purchasing, booking, or participating in any coaching services, you confirm that you have read, understood, and agreed to these Terms.
1. Service Description
Triple Nine Coaching provides professional life coaching services designed to support personal growth, self-awareness, clarity, and goal achievement. Services may include, but are not limited to:
One-on-one coaching sessions (online and/or in-person).
Group coaching sessions or programs (online and/or in-person).
Digital resources, worksheets, and educational materials.
Goal setting, accountability, and reflective support.
Limited email or messaging support between sessions (where specified).
Coaching services are non-clinical, non-therapeutic, and non-diagnostic in nature. Coaching is a collaborative and educational process and does not constitute medical, psychological, psychiatric, legal, or financial advice.
2. Suitability of Coaching & Client Acknowledgement
You acknowledge and agree that:
Coaching is not a substitute for medical care, mental health treatment, psychotherapy, counselling, legal advice, or financial planning.
Coaching is not suitable for crisis situations, acute mental health conditions, or where professional medical or psychological treatment is required.
If you experience distress, mental health concerns, or believe you may be at risk of harm to yourself or others, you are responsible for seeking appropriate support from qualified medical or mental health professionals.
The Coach does not provide emergency services and does not monitor client wellbeing outside scheduled sessions.
By engaging in coaching, you confirm that you are voluntarily participating and are responsible for determining whether coaching is appropriate for your circumstances.
3. Client Responsibilities
To gain the most value from coaching, you agree to:
Attend sessions on time and be fully present.
Complete agreed preparation, reflection, or actions between sessions.
Participate honestly, openly, and respectfully.
Take full responsibility for your decisions, actions, and outcomes.
Communicate promptly regarding scheduling changes or concerns.
You acknowledge that your progress depends on your own effort, commitment, and follow-through, and that outcomes cannot be guaranteed.
4. Confidentiality
All information shared during coaching sessions is treated as confidential and will not be disclosed without your consent, except where:
Disclosure is required by law, regulation, or court order.
There is a reasonable belief of risk of harm to you or others.
Information is used for professional supervision, mentoring, training, or development purposes (with identifying details removed where reasonably possible).
Disclosure is necessary to enforce these Terms or protect legal rights.
Confidentiality does not apply to information that is already public or obtained independently of the coaching relationship.
5. Cancellation, Rescheduling & Refunds
Cancellations & Rescheduling
A minimum of 48 hours’ notice is required to cancel or reschedule a session.
Sessions cancelled with less than 48 hours’ notice, or missed without notice, will be charged in full.
Refunds
No refunds are provided for completed coaching sessions.
Packages or prepaid programs are non-refundable once commenced, except where required by Australian Consumer Law.
If coaching services are cancelled by the Coach, you will be offered a reschedule or a refund for the unused portion.
6. Limitation of Liability & Disclaimer
You acknowledge and agree that:
Coaching does not guarantee specific results or outcomes.
Any decisions, actions, or changes you make as a result of coaching are your sole responsibility.
You rely on coaching services at your own discretion and risk.
To the maximum extent permitted by law, Triple Nine Coaching is not liable for any loss, damage, or expense (including indirect or consequential loss) arising from or related to your participation in coaching services.
Where liability cannot be excluded under Australian Consumer Law, our liability is limited (at our discretion) to the re-supply of the services or the cost of having the services re-supplied.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees that cannot lawfully be excluded.
7. Intellectual Property
All coaching materials, including worksheets, recordings, programs, methodologies, branding, and digital resources, remain the intellectual property of Triple Nine Coaching.
You are granted a non-transferable, non-exclusive licence to use materials for your personal use only. You must not copy, reproduce, distribute, sell, or share any materials without prior written consent.
8. Privacy & Data Protection
We collect personal information necessary to provide coaching services, including contact details, session notes, and payment information.
Your personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, where applicable.
Your information may be used to:
Deliver coaching services.
Communicate with you.
Manage bookings and payments.
Improve our services.
Reasonable administrative, technical, and physical safeguards are used to protect personal data.
International Clients
For clients located in the European Union, United Kingdom, or California, personal data is handled in accordance with GDPR and CCPA principles where applicable. We do not sell personal data to third parties.
9. Termination of Services
We reserve the right to suspend or terminate coaching services, with or without notice, where:
Fees remain unpaid.
Client behaviour is inappropriate, abusive, or unsafe.
There are concerns regarding boundaries or wellbeing.
Continued coaching is not professionally appropriate.
Termination does not affect any accrued rights or outstanding payment obligations.
10. Force Majeure
We are not liable for any delay or failure to provide services due to events beyond our reasonable control, including illness, internet or technology failures, power outages, natural disasters, or other unforeseen circumstances.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of South Australia, Australia.
In the event of a dispute, both parties agree to attempt resolution through good faith negotiation and mediation before commencing legal proceedings. Mediation will take place in Adelaide, South Australia, unless otherwise agreed.
12. Amendments
We may update these Terms from time to time. Material changes will be communicated via email or website notice. Continued use of services after changes take effect constitutes acceptance of the updated Terms.
13. International Clients
For clients outside Australia:
You are responsible for compliance with local laws and regulations.
Coaching services are deemed to be provided from South Australia.
Governing law and jurisdiction remain as stated above.
